Alpha Modus files patent suit against Circle K in retail AI enforcement push

Alpha Modus Corp., a subsidiary of Alpha Modus Holdings Inc. (NASDAQ: AMOD), filed a patent infringement lawsuit against Circle K in the U.S. District Court for the Eastern District of Texas on April 24. The complaint alleges infringement of patents related to real-time consumer behavior analysis, AI-driven personalization, intelligent inventory systems and checkout technologies.
The company announced this action marks the beginning of a second phase in its patent enforcement strategy. Alpha Modus has filed 24 patent enforcement actions to date, with six early-stage settlements reached. The company reported these settlements as "other income" under GAAP compliance requirements.
"We built this platform to scale and that's exactly what we're doing," said William Alessi, Chief Executive Officer of Alpha Modus Holdings Inc. "What we're seeing now is just the visible layer - the depth of this opportunity reaches well beneath the surface."
Alpha Modus claims its patent portfolio covers technologies including real-time consumer behavior analysis, AI-driven personalization at point of purchase, dynamic promotional delivery, intelligent inventory systems and sensor-based checkout systems. The company states it believes a portion of AI retail technology deployed in U.S. retail environments intersects with its intellectual property.
Several earlier-filed cases are advancing toward resolution, with initial matters expected to reach conclusions by the end of 2026 or sooner through settlement, according to the company. Alpha Modus indicated additional enforcement actions are expected as AI adoption in retail accelerates.
The company is also developing commercial products and services based on its patented technologies, aiming to establish itself as a control point within AI retail systems where engagement, promotion and transaction layers converge.
