Esperion (ESPR) settles with Accord Healthcare over NEXLETOL generic

Esperion Therapeutics (NASDAQ: ESPR) announced Monday it reached a settlement agreement with Accord Healthcare Inc. regarding patent litigation over the generic version of NEXLETOL, a cholesterol medication.

Under the settlement, Accord Healthcare agreed not to market a generic version of NEXLETOL in the United States before April 19, 2040, unless certain limited circumstances occur. The agreement resolves patent litigation Esperion filed against Accord Healthcare after the company submitted an Abbreviated New Drug Application seeking approval to market a generic version of the drug.

NEXLETOL is the brand name for bempedoic acid, an oral cholesterol-lowering medication approved by the Food and Drug Administration. The drug is designed for patients at risk for cardiovascular disease who have elevated low-density lipoprotein cholesterol.

Patent litigation against other defendants remains ongoing, including Alkem Laboratories Ltd., Aurobindo Pharma Limited, Dr. Reddy's Laboratories Inc., MSN Pharmaceuticals Inc., Renata Limited, and Sandoz Inc. Esperion stated there is no assurance whether the ongoing litigation will prevent generic versions of NEXLETOL or related drug NEXLIZET from entering the U.S. market before April 19, 2040.

The settlement represents the third such agreement Esperion has reached with companies seeking to market generic versions of NEXLETOL, as indicated in the press release headline.
