ParkerVision files opening brief in expedited Qualcomm appeal case

February 5, 2026 7:31 AM EST

ParkerVision Inc. (OTCQB: PRKR) filed its opening brief with the Court of Appeals for the Federal Circuit in its appeal of a district court decision in ParkerVision v. Qualcomm in the Middle District of Florida, according to a company statement.

The Court of Appeals for the Federal Circuit granted ParkerVision's motion to reinstate an expedited schedule for its appeal on January 21, 2026. Under the schedule, Qualcomm's response brief is due March 16, 2026, with ParkerVision's reply due seven days later. The case will be scheduled for oral argument following completion of briefing.

The court had originally granted an expedited schedule in October 2025, but Qualcomm filed a motion to dismiss the appeal for lack of jurisdiction one day later, automatically suspending the expedited timeline. The January 2026 order indicated parties may address jurisdictional issues in their briefs.

"We are pleased that the CAFC has reinstated our request for an expedited briefing schedule," said Jeffrey Parker, CEO of ParkerVision. "We are hopeful the CAFC will reverse the district court's claim construction which rendered the patent claims nonsensical."

Parker said the company has requested reassignment of the case to a new judge. The case was filed nearly 12 years ago.

ParkerVision has two upcoming trials scheduled in the Western District of Texas: MediaTek beginning March 23, 2026, and Realtek starting April 27, 2026. The company combined two separate Realtek actions into a single trial in late 2025.

ParkerVision develops radio-frequency technologies for wireless communication systems and holds patents in the U.S. and internationally.
