Alpha Modus files patent lawsuit against Inditex and Zara

Alpha Modus Corp. (NASDAQ: AMOD) filed a patent infringement lawsuit against Industria de Diseño Textil, S.A. (Inditex) and Zara USA, Inc. in the U.S. District Court for the Eastern District of Texas on November 19.



The lawsuit alleges infringement of four U.S. patents: 11,042,890; 11,301,880; 12,026,731; and 12,354,121. According to the complaint, these patents cover retail analytics, shopper engagement, inventory intelligence, and automated purchase technologies.



Alpha Modus claims Zara's retail operations, including RFID garment tracking systems, digital surveillance technologies, mobile application features, and inventory replenishment platforms, use its patented methods without authorization.



The complaint seeks monetary damages no less than a reasonable royalty, enhanced damages for willful infringement, and injunctive relief to prevent continued unauthorized use. The case is designated Alpha Modus, Corp. v. Industria de Diseño Textil, S.A. & Zara USA, Inc., Case No. 2:25-cv-01125.



Alpha Modus describes itself as a retail technology company focused on in-store shopper engagement and attribution. The company states it maintains active commercial deployments of its AI-driven analytics and digital engagement tools across retail environments.



The Marshall, Texas-based company is a subsidiary of Alpha Modus Holdings, Inc. According to the press release, Alpha Modus routinely licenses its intellectual property and pursues enforcement actions when it identifies unlicensed use of its patented systems.
